Non-payment of a Penalty Charge Notice

If full payment is not received within 28 days of issue of a PCN, the registered keeper or the person that the council believes to be the owner of the vehicle will receive a Notice to Owner. The registered owner/keeper of the vehicle can appeal.

If no payment is received within 28 days of the date of service of the Notice to Owner, a Charge Certificate will be issued and the outstanding amount is increased by 50 per cent.

Continued non-payment will result in the debt being registered at the County Court and an Order for Recovery will be sent to the motorist. At this stage, the outstanding amount has increased by £8 and a period of 21 days is allowed for payment or for a Witness Statement to be submitted.

Non-payment of a postal (Regulation 10) Penalty Charge Notice

The Penalty Charge Notice by post also serves as the Notice to Owner. If you do not pay or make a representation within 28 days of the Penalty Charge Notice being served by post, we will send you a Charge Certificate, which increases the full amount by 50 per cent. If the council rejects your appeal you may appeal to the Traffic Penalty Tribunal. If your appeal is unsuccessful further non-payment will result in the debt being registered at the County Court and an Order for Recovery will be sent.

Failure to pay

If at that point you continue to fail to pay the outstanding amount it matter will being referred to our bailiffs Bristow Sutor to recover the monies. After this happens, you will receive no further correspondence from us.
